These Terms of Use (“Terms”) govern your use of Ruby, listed on the App Store as “Ruby — Audio Guides” (“the App”), developed by Tigran Barseghyan (“we”, “us”). By downloading or using the App you agree to these Terms. If you do not agree, do not use the App.
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App, and to listen to the guides you have obtained through it, on Apple devices that you own or control, for your own personal, non-commercial use, in accordance with these Terms and Apple’s Media Services Terms and Conditions.
The guides are provided for cultural, historical and informational purposes only. Historical accounts, dates and attributions reflect commonly published sources and may be simplified, contested among scholars, or superseded. Practical details — opening hours, prices, transport, road conditions, cable car operation — change without notice and are not verified in real time.
The App is not a navigation tool. It does not track your location or provide routing. Do not rely on it for navigation, driving, hiking, emergency or safety-of-life purposes. Always follow official signage, local guidance and site staff.
Several sites described are active places of worship. Access, dress codes and photography rules are set by the institutions themselves and may change.
You agree not to: copy, extract, re-record, redistribute, broadcast, publicly perform, or make available the audio, text or images from the App; use them in any commercial tour, product or service; reverse engineer, decompile or modify the App except as permitted by law; circumvent or attempt to circumvent the App’s download verification, attestation or purchase checks; or use the App in violation of any applicable law.
The App, including its design, code, recordings, narration, written guide text and photography, is owned by us or used with permission, and is protected by copyright and other laws. Your purchase grants the personal listening license in section 1 — it does not transfer ownership of any content or grant any right to redistribute it.
The App uses Google Firebase to deliver its catalogue and audio and to collect anonymous usage analytics, and Apple’s App Store to process purchases. The “Open in Maps” feature hands a place’s coordinates to whichever map app you choose. We are not responsible for the availability, accuracy or conduct of third-party services, which are governed by their own terms.
The App is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy or non-infringement. We do not warrant that the App will be uninterrupted or error-free, or that any guide will be available at a given time.
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential or exemplary damages, or any loss of data, profits or goodwill, arising from your use of or inability to use the App. Our total liability for any claim relating to the App shall not exceed the amount you paid for the App and its in-app purchases in the twelve (12) months preceding the claim.
Nothing in these Terms limits liability that cannot be limited under the mandatory law of your country of residence.
These Terms are effective until terminated. Your rights under these Terms end automatically if you fail to comply with them. Upon termination you must stop using the App and delete it.
These Terms are between you and us, not Apple. Apple has no obligation to provide support or maintenance for the App. Apple is not responsible for addressing any claims relating to the App. Apple is a third-party beneficiary of these Terms and has the right to enforce them against you.
We may update these Terms from time to time. The current version, with its effective date, will always be available at this page. Continued use of the App after changes take effect constitutes acceptance.
These Terms are governed by the laws of the country of the developer’s residence, without regard to conflict-of-law rules, except where the mandatory consumer-protection law of your country of residence applies.
